Schedule V drugs are believed to have the lowest risk for abuse or addiction, with many medically accepted uses. Penalties associated with Schedule V drugs are the lowest. Fines can range from $1,000 to $50,000, with a maximum of 10 years in prison.

Items considered as drug paraphernalia in drug charges can be pretty broad. Anything that can be used to grow, process, store, or use a controlled substance can be considered drug paraphernalia. This definition can include almost anything and can bring a penalty of up to six months in jail and a $500 fine.
